TERMS AND CONDITIONS

This is a legal agreement between you, "YOU", and Aussie Clans Pty Limited, "AUSSIE CLANS". BY REGISTERING YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

1. Site Operation

1.1 This site is a free to use community site. As such it is a medium for the gaming community to join together and interact. It is not to be used for any other purpose.

1.2 AUSSIE CLANS will not accept any responsibility for any content, purpose or use of the site for any purpose beyond the purpose set out above.

1.3 None of the content of the site can be copied or reproduced or used anywhere else for any other purpose without the express written permission of AUSSIE CLANS.

1.4 AUSSIE CLANS binds YOU not to place any offensive, defamatory or illegal material, of whatever nature, upon the site.

1.5 Notwithstanding this, AUSSIE CLANS does not take any responsibility for content placed by others on the site, but may suspend or terminate registration and logins of any member, or prevent the ability of any member to post content on the site.

1.6 AUSSIE CLANS reserves the right to remove material, and to alter both user classes available, and access and registration by users within user classes.

1.7 AUSSIE CLANS reserves the right to prevent or terminate user registration without providing any explanation.

2. Site Content

2.1 AUSSIE CLANS makes it clear that the opinions expressed by users on the site are not necessarily endorsed by AUSSIE CLANS, nor are opinions relating to products and their desirability or otherwise.

3. Commercial Arrangements

3.1 AUSSIE CLANS may or may not have commercial or other arrangements with manufacturers or suppliers of material, either directly or indirectly, or through related entities. AUSSIE CLANS and its related entities are commercial operators in the electronic gaming market place.

3.2 AUSSIE CLANS takes no responsibility for products sold or decisions made by YOU as a result of content on this site.

3.2 It is important to understand that most electronic games involve and element of challenge and fantasy. These games do not reflect reality, and YOU should, under no circumstances, attempt to emulate any of the activities in any of the games featured by Aussie Clans.

4. Prices

4.1 Subject to these terms, the price of GOODS referred to on the site is as recommended or advised from time to time and may be out of date. YOU should check prices yourself before committing to any purchase of a product referred to on the site.

5. Shortages and Defects

5.1 All descriptions, illustrations and specifications, relating to GOODS, which are contained in AUSSIE CLANS website, catalogues, price lists and other advertising matter do not form part of any subsequent agreement or contract of sale for the GOODS.

6. Limitation of Liability

6.1 AUSSIE CLANS excludes all other warranties and representations and is not responsible for any liability or costs incurred as a direct or indirect result of the use, operation, installation or alteration or repair of GOODS by YOU or its employees or agents.

6.2 AUSSIE CLANS does not warrant the accuracy of performance figures or statistics for any of the GOODS.

6.3 AUSSIE CLANS is not liable to YOU under any circumstances for any consequential or indirect loss or damage arising out of the supply and sale of GOODS to YOU in accordance with these terms and conditions of sale.

7. General Provisions

7.1 If any provision of this agreement is void or unenforceable the provision shall be severed from this agreement to the extent it is void or unenforceable without affecting the validity or enforceability of the rest of the agreement.

8. Privacy

8.1 Data on this site is subject to change without notice. Although every step is taken to protect the privacy of any corporate or personal information provided transmission is at your own risk. It is your responsibility to ensure any corporate or personal information provided is kept secure. YOU must not reproduce, distribute or disseminate the information and intellectual property contained on our website or in this software by any process or in any form.

9. Jurisdiction

9.1 This agreement shall be governed by and interpreted under the laws of Queensland Australia.

10. Ownership

10.1 The software, configurations, layout, logos, symbols, content and intellectual property ( "the I P ") to this site is owned or licensed to/by AUSSIE CLANS, and is protected by the Australian copyright laws, international treaty provisions, and all other applicable laws.

10.2 YOU may not, without explicit prior written permission from AUSSIE CLANS:

(a) use, modify or transfer the software, or copy the I P in whole or in part;

(b) reverse-engineer, decompile or otherwise attempt to derive the Source Code for the the I P in whole or in part;

(c) make copies of or distribute, for profit or otherwise, or authorize or permit the copying or distribution of the I P;

(d) make alterations to the I P or merge it into any other software or medium;

(e) make verbal or media translations of the I P, in whole or in part;

(f) make telecommunications data transmissions of the I P in whole or in part;

(g) distribute the I P on either a permanent or temporary basis to others;

(h) make available any part of the I P to any third party.
